Biden's 'Unauthorized' Climate Rule

A federal judge, appointed by former President Donald Trump, has deemed that the Biden administration overstepped its authority by implementing a 2023 regulation that required states to monitor greenhouse gas emissions.

This decision by Judge James Wesley Hendrix invalidates the rule, which aimed to have states track emissions from vehicles on U.S. highways and set goals for reducing carbon dioxide emissions.

“A federal administrative agency cannot act without congressional authorization,” Hendrix wrote in his ruling, adding, “the Court concludes that the rule was unauthorized.”
